Open Question: What is considered a day according to the NYS lemon law?
October 20, 2009 at 9:34 pm

The New York State Used Car Lemon Law says that if a vehicle is out of service for 15 or more days then the dealer is required to take it back. What exactly qualifies as a day (obviously if the dealer has the vehicle for a full 24 hour day then this is considered one day). Are partial days, considered in this total? Is there some sort of restriction, such as a partial day counts only if the vehicle was there between certain hours? Also do weekend days count? I spoke with someone from one of the regional attorney general's offices and they told me that weekends are included, but they were not very knowledgable on the Lemon Law. Any information regarding this topic would help. Thanks.

Open Question: If a car fails inspection in MA and is under the used vehicle warranty, does the dealership have to repair it?
October 19, 2009 at 9:31 pm

Firstly some background information. All of this occurred in Massachusetts. I financed a car on Saturday, a black 2005 Nissan Sentra with 56,000 miles on it. I live in Massachusetts, and according to law the dealership issued me a 60 day used car warranty. Financing went through without a problem. I wasn't able to insure the car until this morning, at which point in time I was able to register it and get the plates for it, and drive it. I went to my father's house, which is approximately 12 miles from the dealership, and then went to a state licensed inspection station about a mile away. Unfortunately, I failed the inspection due to the fact that my tires were too bald, they did not have enough tread. Everything else passed. My question is can I make the dealership replace the tires? I do like the car, and it's in very good shape, very clean, but I don't want to pay to replace the tires, nor do I want to get a refund under the lemon law. Are tires covered under the warranty? It needs to be replaced to pass the state inspection, so they have to do it, right? It's the general MA state used auto warranty issued to all cars, nothing special so they have to cover it, do they not? Please only answer if you understand the Massachusetts used vehicle warranty law, every state is different and if you don't live in MA or at least understand the law, don't reply. Just because you had a car in New Jersey doesn't mean things work the same in MA. Thanks in advance.
