How Does the Magnuson-Moss Warranty Act Protect You? by Ryan Frank

Nearly everyone has heard the term "Lemon Law" and most people know that it pertains to dealers and manufacturers selling defective cars to the public. Thankfully there are a few statutes that protect you if you are sold a "lemon" car. One of them was constructed in 1975 as the Magnuson-Moss Warranty Act which was designed to prevent deception, improve the accuracy of information given to the buyer and improve competition in the marketplace.

What does the act apply to?
The Magnuson-Moss Warranty Act applies to any item or consumer product that is worth more than $15, stating that it has to be accompanied by a warranty with readily understandable language for the consumer. The seller must provide the buyer with detailed information about the warranty and its coverage. It was originally intended to give consumers more information about what they were buying to ensure better customer satisfaction. It also holds the seller to the standard of product of which they are selling.
What does it not apply to?
The act does not require companies to provide a warranty. If a warranty is offered by the seller then in must comply with the Magnuson-Moss Warranty Act but it is not, by law, required to do so. Congress wanted to give buyers an option to shop around for the best products and warranties so that it would create competition and spread economic growth. Manufacturer's have the option to not provide a warranty but since most competitors will offer one as an incentive, it would be unwise not to.
The act also does not apply to resale items. Most vehicles that are resold are sold "as is"; however, a dealer or manufacturer cannot knowingly sell the consumer a defective vehicle without disclosing it first. The consumer will be covered under the San Diego, CA lemon law if it can be proven that the dealer knew about the defect but did not share that information with the buyer. If the consumer agrees to buy the defective vehicle "as is" then the seller is covered legally.

So, I got into and accident. My car was totaled. I got $3000 from my insurance. Looked around for a car, never had to make car payments. So I didn't want to start. I figured for that much money I could find something decent. But, now I'm thinkin I should have maybe bought a little more expensive car, and just made some payments. Not too much, but at least for a little more decent car. My friends are saying I was swindled. I don't know. I was sooooooo excited. My fault though, I didn't test drive it. Just assumed It drove good from the way it sounded. It rides ok when I'm by myself. But, when someone else gets in the car, it doesn't accelerate well. I think that's a little dangerous. I still owe $500 on the car. What should I do, I mean...it's a pretty good car, but I don't know if I want it. So, the dealer said something about the "Lemon Law". Oh boy do I need help. I wanted to trade it, but it has too many miles. But, there are some cool used car dealers, so I was wondering If I could trade it to a dealer like the one I bought this damn thing from, and then make payments on another car... I DON'T KNOW....somebody please help a sista out.

So I have an '05 Ford Explorer. About 6 weeks ago, I tried to start the vehicle, it wouldn't. After a trip to the local shop, since I thought something had to be wrong with it, they informed me it was just a dead battery. So I paid to have it replaced and such. Then within 2 weeks, all my gauges stopped working until I reset the instrument panel communication screen thing (The one that tells you your gas mileage and outside temp and all that). Then I was getting a "Charging system error" on the same panel. So I took it to a different shop (the professionalism and customer service at the first one was horrible). They found a ground wire that wasn't connected (after having my truck for 2 days). So they fixed that, the error went away. Now about 3 weeks later, my battery is dead again. And this time, a jump wouldn't start my truck (my husband drives a small car though, I think that may have something to do with it). I'm livid since I've only had this vehicle since late June, so less than 6 mos. Anyone have any ideas on what could have caused the battery to go dead 3 times, but not come up on a dealership diag? I'm going to call the roadside assistance number tomorrow to get them to come out and try to jump it. I'm so frustrated and I found out tonight my state lemon law doesn't apply to vehicles over 2 years old. I'm pretty sure I was sold a piece of crap. Any ideas what could be causing this reoccuring problem? Yes, the second shop knew about the dead battery problem. The second shop was the dealership I bought the truck from.

I have never towed with it and have already had to relace an emmission valve that had stuck.Luckily It was just under this 12000 mile warranty for the part or I would have been stuck with the bill....and now my rear diff. assembly? I mean all this within 8 months of purchase?What next?

In mid-September I bought a car from an acquaintance who is a mechanic. After a "precautionary inspection" by her and another inspection by one of her mechanic friends, she assured me the car was in good working order. Tuesday morning the car died on me and was towed to a local machine shop. The car threw a rod. The engine has to be replaced. So far, the cheapest estimate is $1,000 MORE than I paid for the car. Do I have an recourse?

Is there anyone out there that is able to link us to someone who can not be afraid to Fight for what is right? I have proof of everything and not one person is wanting to speak. Ford took over 50,000 that from us for a used vehicle we paid 19,500. Can not believe that they got away with this! T attorney General said get a lawyer ...did that.. the lawyer,after we met with him several times said"oh, I have a conflict of interest! Sen t us to another lawyer ..lawyer says ..Sure they won't take the case...they represent Ford...went to another lawyer..said File Bankruptcy...we said no. went back to the attorney general ...he said get a lawyer...any lawyer we went to said that it would cost the full amount if we win...to top it off ...this whole time all the repairs we had would have fallen under warranty and the lemon law...Here is what they did... In the mileage area on contract it should have been listed as KILOMETERS. the vehicle came from Canada!...I also have a vehicle vin search that I paid for from Canada. Stating that the Car was made in 1995 and they sold it to us as a 2000. Want to know what we said before we bought it"Please don't screw us over we have a daughter with a medical situation" Want to know the first question we asked before signing the papers..."Is this vehicle in Mileage or kilometers?" this is sooo wrong. We almost lost our home! Hey does anyone know how to get ahold of John Stossell or someone who has direct links to William Ford. so i can show him the paperwork. Everyone local says Ford is responsible not the dealer! sorry for the confusion ...We bought the vehicle in 2004 as a 2000 for 19,500...the repairs cost a bundle ..went to take it back to the dealer and dealer said"it was not covered,under warranty or lemon law" Not true ...If the vehicle was listed as kilometors on the contract like it sould have been it it would have fallen under the lemon law to return and for all repairs (engine blew. tie rod also snapped in half as daughters were driving it!) We have been fighting this for some time! i said dealer was responsible as well. because the vehicle came from another country is the reason behind ford being responsible. that is the way i understand it. In research of the vehicle the Ministry of Canada gave us a vehicle vin search showing the date the vehile was made/existed...1995. We paid for the vin search

What are the chances my attorney would win in a lemon law case against nissan? My 2005 Nissan Armada has had Major problems. 1.Premature wear of brakes and steering wheel jitters (recall)- took them 4 tries to fix this!*fixed 2.Brake light would be lite on dashboard when the e-brake wasn't even in, result, couldn't move my car- 2 times in the shop *supposedly fixed. 3. Exhaust manifold was cracked on both sides- 1 time in the shop *Fixed 4. Car would randomly turn off while i was Driving- 1 Time, i threatened to sue and my car has been at the nissan dealership for 7 days *not fixed yet fortunately i got the extended service warranty so how do you think the case will go? and oh yea i keep all of the service records too. Please be honest and mature. Thanks
