LEMON LAW




Q. Does South Carolina have a lemon law? If so, when did it become effective?
A. Yes, South Carolina has a lemon law which became effective October 3, 1989.


Q. When is a car considered a lemon under the law?
A.

The law defines a lemon as a new motor vehicle (passenger car, van or truck) that:


1. was bought on or after October 3, 1989;

2. has a defect that impairs its use or will lower its market value substantially; and

3. which the manufacturer cannot repair within a reasonable time.


Q. What is covered in the law?
A. Defects which do not substantially impair the vehicle's use, market value or safety are not covered. Also not covered are defects caused by the consumer's abuse, neglect or unauthorized alteration of the car, or defects that do not show within the first 12,000 miles or 12 months, whichever occurs first.


Q. Does the lemon law cover anything other than new motor vehicles?
A. No. It only covers passenger motor vehicles (cars, vans, small trucks).


Q. If I discover a defect what do I need to do?
A. You must notify the manufacturer (or its agent) of the defect during the term of the express warranty. The manufacturer must make any repair efforts at no cost to the consumer and within a reasonable amount of time. The law presumes a reasonable amount of time to be either three repair attempts for the same defect or thirty days out of service for repairs. The 30 days do not have to be consecutive.


Q. What happens if the manufacturer is unable to repair the defect?
A. If the defect cannot be repaired, the manufacturer has the option of whether to replace the vehicle or rescind the agreement and refund the money. If the manufacturer elects to rescind the agreement and refund the money, the refund must be for the full purchase price of the vehicle, less a reasonable allowance for the consumer's use. The full purchase price includes: 1) applicable finance charges and 2) all governmental fees, such as sales tax, license fees and registration fees.


Q. Describe the steps I must take in getting a refund or replacement for my vehicle.
A. Before you request a refund or replacement you must first participate in any arbitration procedure the manufacturer may have established (the decisions are binding on the manufacturer). This type mediation is know as an "informal dispute settlement procedure." The "informal dispute settlement procedure" must:

1. set up requirements for consumer notification;

2. be free from the manufacturer's influence;

3. be free of charge to the consumer;

4. generally settle the dispute within 40 days


Q. What can I do if I am not satisfied with the mediation decision?
A. If after arbitration, you remain unsatisfied, you can then file suit in the courts.Consumers should remember to buy cars only from reputable dealers and should read the warranty carefully and save all documentation related to the car and to any repair work for their records. If you have problems with your new car you should begin to keep the following records: a description of defects and details of contacts(including the date and name of the person with whom you spoke); a log of the amount of time the car was out of service and complete written records of routine service.


Q. If the lemon law does not cover the car I purchased do I have any other recourse or protection?
A. Possibly. The general law of sale, including warranty law may still apply. In addition, you can always file a complaint with the S. C. Department of Consumer Affairs.

My husband and I purchased a car a little over a year ago. The car was fine at first and now we are finding out there is one thing wrong after another. I was looking up lemon laws and it states: In the first eighteen (18) months or first eighteen thousand (18,000) miles, after vehicle delivery Repaired for serious safety problem at least two (2) times Required repairs four (4) or more times for the same problem Out of service for a cumulative total of thirty (30) or more days. The car was sold to us and told us (and stated in the sale document) that gthe only thing we would need to replace is the drivers side air bag. We were okay with that because my husband can do it himself. We replaced the airbag and we come to find out the wiring throughout that goes to the srs unit is faulty. Therefore, we will and can not drive it because its a serious safety hazzard and the CA highway patrol will not approve this car to be driven. Does the lemon law apply to us? It's going to break us to get another loan for another car, whne we'd still have to pay for this one.

Background Info- Mom's car just recently broke down, and we made a deal that she would take my recently-bought-car and put her name on a new one, for me. We went to Kia a few times to look around, never thought that anything came from that; however, I just recently discovered Mom bought the Kia Soul, which is a great and terrific car, but not the one we settled on. The problem is, and because I did not know to tell her any differently, she bought the base version--cheapest-$13,900-which does not have some safety options I need and is a manual which will not stand up to any of the hills in the beautiful Colorado.. Kind of a pathetic situation I am in,I am not able to keep the car, and because of family situations etc etc she needs the one I currently have. She bought the Kia about 2 to 3 weeks ago, will not know how many miles are on it Bu hardly any more than 150 would be a fair guess. I will see the car tomorrow, so I will update about that then. We both will be going to the dealership after Christmas to try and exchange for the next version. (Which is only $1000 more.) I know by law, you can only return a car 3 days after you buy it, but I need to find possible ways the dealership would be interested in negotiating. .. I know if I were to point out a problem in the car it could work to my advantage but I am not a fan of playing the system like that, I just need a way to get myself out of this. Does anyone out there know any tricks-of-the trade, Worked at a dealership, heard of things like this happening, tips, suggestions, Any and all helpful, positive feedback would be Greatly appreciated. Thank you all in advance for reading. What can I do and say to get the dealer to exchange it in? I'd like to know what I am getting myself into before I go in. This Needs to be possible, I will not settle for No until I have tried everything. I will be reading up on Lemon Law but don't think it will work for my situation. Please Please Please let their be something my hopes are low by this point! Happy Holidays

Open Question: Legal recourse for Lemon Car?

I have looked up the Lemon Law in MD, where I bought the vehicle and live, it only covers vehicles that are less than 48 months old. I need to know if I have any recourse. I purchased a vehicle from a local dealership. It is a used vehicle, '05 Ford Explorer. The truck was dirty and one window motor stopped working within a month of buying the truck. I bought the vehicle in June. Since then, it's been in the shop (at the dealership I purchased from) 5 times now for a battery problem. The truck continuously won't start. They've ruled out the common problems, they recently replaced a few obscure parts. This would be the 6th time I will have to have this truck in the shop, and in the last 4 months I've only been able to drive the truck for about 3 weeks of that time. The shop keeps trying, I'm just tired of it. I'm trying to figure out if there is any legal recourse for me to get my money back on this car. I don't want another car from this dealership, obviously. So far, they are being really good about working with me, but I need a reliable vehicle. I really just need to know if there is something I can do.

I was talking to my dad about my cars head gasket blowing. My husband and i have replaced the belt, the water pump and fixed two other things. he use to be a mechanic. Well my dad asked what year the car was and it is a 2000 Pontiac grand am. we about it 6-8 months ago from a dealer in Jacksonville. He said we may apply for the lemon law. can someone tell me if we apply and what we need to do if we do apply? thank you so much!

I think I bought a lemon car (Rx8) yesterday can someone please help? I went in picked out a used 2004 Mazda RX8 flawless in every aspect, test drove it fully loaded though it was a good deal for my trade in of my saturn ion. Called Navy Federal Credit Union and got a loan to start processing and it takes 24 hours to get an approval. Well the manager of the car lot got me in the car over the weekend filled out all the paper work to buy the car and what not and said to me with my roomie sitting next to me if the loan does not go through or I do not want to accept the finance rate other then what i was quoted I do not have to accept the loan and we trade vehicles back I get my saturn he keeps the Mazda Rx8 back. I drove off the lot to go home and 20 mins on the road the Mazda breaks down smoke pouring out of the engine bay and sputtering for a total loss of power and several misfires. I do not think there is a used lemon law in florida HOWEVER seeing as I called the loan company 2 hours later and canceled the loan from processing I do not have to buy that Mazda Rx8 still do I ? I called them this morning , texted them and emailed them to let them know "The loan did not go through I am coming back for my saturn in the am" seeing as there was no exchange of money can I still get my saturn back ? . THERE IS ALSO NO USED CAR LEMON LAW IN FLORIDA I DO NOT BELIEVE. Well I think the manager has to give me back my saturn...there was no exchange of funds to anyones hands. I cancelled the loan before it went through and the dealer sat there and told me if the loan does not go through he just wants the rx8 back. IF I CANCELLED WITH THE LOAN AGENCY AND TOLD THE CAR LOT WITHIN 24 HOURS I STILLL SHOULDNT BE FORCED INTO THE DEAL CORRECT? THE MANAGER SAT THERE AND TOLD ME AND MY ROOM MATE IF I DONT WANT THE CAR AFTER THE LOAN DOESNT GO THROUGH HE JUST WANTS THE RX8 BACK.... I didnt wreck anything... cars just dont break down while you drive them unless it was an intermident problem they knew about. Thats shady I was just driving home and there stupid car fucking broke down on me that i was BORROWING for the weekend. THERE WAS NO EXCHANGE OF MONEY i am getting my car back. Consumers have rights too..i guess im speaking to all the used car salesman today that arent at work because you all sound the same... none of you think its fishy the lot let me drive away with a car that breaks down 20 mins later... I just called the us bank the financing company for the saturn and the car is still legally mine... So i guess im going to get MY saturn ion tomorrow.

The New York Lemon Law for used cars states that a used car is considered: "if it was purchased, leased or transferred after the earlier of a) 18,000 miles of operation or b) two years from the date of original delivery" The car I'm looking into buying is a 2003 Chevy Cavalier with 6,280 miles. I was wondering if the vehicle would be covered under the lemon law. It just seems a little strange to me that a 7 year old car has less than 7K miles on it.
